Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Commazaar website, mobile applications, and related services (together, the "Services") operated by Commazaar ("Commazaar", "we", "us", or "our"). Please read them carefully before using the Services.

1. Agreement to these Terms

By accessing or using the Services, creating an account, joining our waitlist, or ticking the acceptance box at sign-up, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you must not use the Services. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. About Commazaar

Commazaar is a rewards platform that helps consumers earn cashback, points, and partner perks from everyday spending, and helps businesses reach shoppers through offer-based rewards.

Some features may be unavailable in certain countries while we roll out the Services across Europe. We may offer early access, beta features, or waitlist registration before full launch in your area.

3. Eligibility

To use the Services you must:

  • Be at least 18 years old, or the age of majority in your country if higher.
  • Have the legal capacity to enter a binding contract.
  • Not be prohibited from using the Services under applicable law.
  • Register only one personal account unless we expressly authorise otherwise.

4. Your account

You may need to create an account to use certain features. You agree to provide accurate, current information and to keep your account details up to date.

You are responsible for maintaining the confidentiality of your sign-in method and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorised access.

We may refuse, suspend, or close accounts that violate these Terms, pose a security risk, or are used fraudulently.

5. Email communications and consent

By creating an account or joining our waitlist and accepting these Terms, you agree that we may send you emails relating to the Services. This includes transactional messages such as sign-in links, security notices, waitlist updates, and important service announcements.

You also consent to receive marketing and promotional emails from Commazaar about product launches, features, partner offers, surveys, and related news. These communications are an integral part of how we operate the Services during rollout and after launch.

You may withdraw consent to marketing emails at any time by using the unsubscribe link in our emails, updating your notification preferences, or contacting [email protected]. Opting out of marketing does not affect essential service communications where we have another lawful basis to send them.

6. Waitlist and regional availability

If Commazaar is not yet available in your country, you may join a waitlist. Waitlist registration does not guarantee access or a specific launch date.

We may use your email address and country or region to notify you when the Services become available, to invite you to early access, and to send related updates. Placement on a waitlist does not create any entitlement to rewards, offers, or compensation.

7. Rewards, offers, and redemptions

When the Services are live in your area, the following additional terms apply:

  • Offers, earn rates, partner availability, and redemption options vary by location, merchant, and time and may change without notice unless otherwise stated for a specific promotion.
  • Points, cashback, or other rewards have no cash value until successfully redeemed under the then-current programme rules.
  • We and our partners may set minimum balances, expiry periods, verification requirements, and redemption limits.
  • Rewards may be reversed, withheld, or cancelled if we reasonably believe an offer was claimed in error, a receipt was altered or submitted fraudulently, or these Terms were violated.
  • Third-party gift cards, payouts, and perks are subject to the issuer's terms and availability.

8. Acceptable use

You agree not to:

  • Submit false, misleading, or manipulated receipts or transaction information.
  • Use bots, scripts, or other automated means to create accounts, claim offers, or abuse the Services.
  • Circumvent geographic, eligibility, or offer limits.
  • Interfere with the security or operation of the Services.
  • Reverse engineer or attempt to extract source code except where permitted by law.
  • Use the Services for unlawful purposes or in a way that infringes the rights of others.
  • Resell, sublicense, or commercially exploit the Services except as expressly permitted.

9. Intellectual property

The Services, including software, design, text, graphics, logos, and trademarks, are owned by Commazaar or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Services for their intended purpose.

You retain ownership of content you submit, but grant us a worldwide, royalty-free licence to use, store, reproduce, and process that content as necessary to operate and improve the Services, validate rewards, and comply with law.

10. Third-party services and links

The Services may integrate with or link to third-party websites, apps, payment providers, authentication services, and partner offers. We do not control third parties and are not responsible for their content, policies, or practices.

Your use of third-party services is at your own risk and subject to their terms. Partner offers are provided by the relevant partner and may be modified or withdrawn by them.

11. Availability and changes

We strive to keep the Services available and accurate but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Services at any time.

We may update these Terms from time to time. If changes are material, we will provide notice as required by law, which may include email or an in-service notice. Continued use after the effective date constitutes acceptance, subject to your statutory rights.

12. Suspension and termination

We may suspend or terminate your access immediately if you breach these Terms, create risk or legal exposure for us, or where required by law.

You may stop using the Services at any time and may request account closure by contacting [email protected]. Provisions that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitations of liability, and dispute provisions.

13. Disclaimers

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that rewards will always be available, that partner offers will continue, or that the Services will meet your expectations. Nothing in these Terms excludes or limits warranties or rights that cannot be excluded under applicable consumer law.

14. Limitation of liability

To the fullest extent permitted by applicable law, Commazaar and its directors, employees, partners, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from your use of the Services.

Our total liability to you for all claims arising out of or relating to the Services or these Terms is limited to the greater of (a) the amount you paid us, if any, in the twelve months before the claim arose, or (b) EUR 50, except where liability cannot be limited under mandatory consumer protection law.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Commazaar from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, your breach of these Terms, or your violation of any law or third-party rights.

16. Consumer rights

If you are a consumer, you benefit from mandatory provisions of the law of your country of residence. Nothing in these Terms affects those non-waivable rights, including rights relating to faulty digital services where applicable.

17. Disputes and governing law

We encourage you to contact us first at [email protected] so we can try to resolve concerns informally.

These Terms are governed by the laws applicable in the European Union, without regard to conflict-of-law rules. If you are a consumer residing in the European Economic Area, the United Kingdom, or Switzerland, you may also benefit from mandatory protections of the laws of your country of residence, and you may bring proceedings in the courts of your country of residence where those laws allow.

If you are a business user, the courts with competent jurisdiction in our place of establishment shall have exclusive jurisdiction, subject to any mandatory rights you may have.

18. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.

These Terms, together with the Privacy Policy and any offer-specific terms we present to you, constitute the entire agreement between you and Commazaar regarding the Services.
